Milieu Agency · Content & use terms
Content & permissions.
The terms governing media-kit publication, authorized promotion by Milieu Agency, and what happens when permission is withdrawn.
Effective and last updated October 20, 2026 · Version 2026-10-20-integrated-promotion-v2
1. Scope and affirmative acceptance
These Content & Use Terms govern the permissions you affirmatively grant to Milieu Agency ("Milieu," "we," "us") through milieuagency.com. "Submitted Content" means material and information you upload or provide for your media kit. "Public Kit Content" means the portion you select for public consumption and Milieu approves for publication, including selected photographs, videos, audio, professional name, biography, likeness, experience, and other selected public profile information.
The portal service license, publication release and agency promotion license have distinct scopes, but permission can be captured in one clearly described acceptance. For adult talent, signup includes an express promotional grant in the displayed account acceptance. An existing adult member who has not granted the standing permission can accept the combined publication and promotion release when submitting a kit. The acceptance checkbox starts unchecked. A private upload, a public social-media post, or continued use of the site does not itself grant promotional rights. Existing members and earlier releases are not automatically enrolled or expanded by this revision.
Read these terms with the Privacy & participation notice. Neither document creates exclusive representation, employment, a guaranteed booking, or a guarantee of earnings. Separately agreed project and payment terms govern their respective subjects.
Talent age groups. Select your accurate age group: 13, 14–15, 16–17 or 18+. Talent accounts are offered from age 13 under the youth participation policy; accounts for children under 13 are not offered. Brand and collaborator representatives must be at least 18. Age declarations help Milieu assess rights, work availability and suitable offer types. A declaration is not verified age evidence, legal work authorization or a guarantee that a particular project is available.
Age 13: private kit only. You may create, save and edit a private media kit. It is accessible to you and authorized agency personnel, with necessary service-provider processing. It cannot be published, indexed, released through public media or social previews, printed for visitors, used for agency promotion, or used to receive or accept work offers. These restrictions remain until you are at least 14 and Milieu reviews and verifies an updated age declaration. Turning 14 does not automatically publish a kit or authorize work. Any later public release requires fresh publication consent, applicable permissions and agency review.
Talent ages 14–15 and 16–17. Both age groups may create an account and media kit. Public-kit submission requires the necessary rights and permissions and agency review. Before accepting each offer, a parent or legal guardian must separately sign in and approve its specific terms, followed by agency verification of the guardian’s identity and relationship and review of applicable work requirements. That approval is specific to the offer. Signup, kit submission and offer approval do not grant the general agency promotion license; separate lawful guardian-assisted permission is needed for promotional reuse for all members under 18. Members aged 14–17 may use and share referral codes and track qualifying rewards under the referral terms. Age-13 accounts are not eligible for referral participation. Payments involving a minor require separate guardian-assisted financial review and a lawful supported arrangement; accepting referral terms does not provide that authorization. Self-service payout setup and payment agreements remain limited to eligible adults.
Work eligibility depends on the project. Age 14 is Milieu’s earliest age for considering public-kit participation and offers, not a universal legal working age. Your location and work location, role, duties, hours, schooling, required permits, parental permissions and other applicable rules determine availability and suitable offer types. Indiana’s youth-employment guidance distinguishes rules for ages 14–15 and 16–17; Indiana law does not authorize work elsewhere. Neither an account nor guardian approval replaces a lawful project agreement or requirements where you live and work.
2. Ownership and authority to grant permission
You or the applicable rights holder retain ownership of Submitted Content. No assignment of copyright is made under these terms. You represent that information you provide is accurate to the best of your knowledge and that you own, or have sufficient permission to grant, the rights required for each use you authorize.
Being depicted in a photograph does not necessarily make you its copyright owner. Obtain any necessary photographer, videographer, music, performer, trademark or other permissions, including permission covering promotional reuse where you select it. Do not submit confidential material or another person's private information without authority. A public social post, tag, screenshot or accessible link does not establish a commercial-use license.
3. Portal services and public-kit publication
When you accept these terms and submit content, you grant Milieu a nonexclusive license to store, copy, process, format and review it, and to permit service providers acting for Milieu to do the same, only as reasonably needed to operate the portal, maintain your draft, administer your choices, and meet applicable legal obligations. This operational permission does not make a private draft public.
Your publication release authorizes Milieu to display and deliver your selected Public Kit Content through your approved media kit. That release may be accepted together with the promotional grant described in Section 4; publication still requires review of the selected content and agency approval. Search indexing and release of gated social or website links follow your separate choices. Visitors may view the kit and share its page address. Downloading or printing a kit requires prior agency approval through the print-request process. Approval is limited to the named requester, the reviewed kit and the stated purpose; export access expires after 24 hours and may be revoked. A print approval does not authorize separate image or video downloads, scraping, reposting, redistribution, advertising or an implied endorsement. Those uses require separate permission from the agency and any applicable rights holders, except where applicable law permits otherwise.
Visitor content controls, updated October 19, 2026. The site restricts ordinary browser copying, direct media sharing and printing, and requests that automated crawlers exclude talent media. These measures do not prevent every screenshot, recording or determined extraction. They do not expand talent licenses or remove legal rights.
Routine unpublishing. A signed-in member may select Request unpublishing in the portal and provide a reason. The kit stays published under your existing permission while Milieu reviews the request, for no more than 7 calendar days. The agency may approve and hide the kit, or decline with a written reason shown in your portal. If no decision is recorded within 7 calendar days, the kit is hidden automatically. A declined routine request does not prevent a new request, immediate consent withdrawal, or a privacy or rights complaint.
This review process does not extend a license, prevent consent withdrawal or authorize continued publication after permission ends. Account closure or deletion does not itself grant permission to keep a kit public indefinitely. You may request closure or deletion by contacting us, including after you lose access to the portal; there is no automatic account-deletion control in the portal. See Section 6 for immediate withdrawal and Section 8 for rights requests.
4. Express license for Milieu Agency promotion
When you affirmatively accept the displayed promotional grant at adult talent signup or in the combined kit-submission release, you grant Milieu a nonexclusive, worldwide, royalty-free license to reproduce, reuse, publish, display, perform, distribute and make the reasonable adaptations described below of your current and future approved Public Kit Content. A valid affirmative acceptance previously made through the portal promotion control remains subject to its accepted scope and any later withdrawal. This is a standing permission: after it is recorded, you do not need to sign another marketing release for each kit revision or each Milieu promotion within this scope. You also authorize use of your professional name, photograph, image, likeness and recorded voice contained in that content for the same purposes, to the extent you may lawfully authorize those uses.
Permitted purposes and channels. Milieu may use that content to introduce and promote you, showcase its talent community and services, attract collaborators and talent, and market Milieu Agency. Permitted channels include Milieu's websites and landing pages, organic social posts, paid advertisements, referral promotions, electronic mail, press and presentation materials, digital brochures, and printed promotional materials. Content may appear alongside Milieu's branding, contact details, kit links and referral information.
Production and distribution. Milieu may crop, resize, compress, excerpt, caption, subtitle, combine or reformat content to fit those channels, without materially misrepresenting your identity, statements or performance. Milieu may grant limited sublicenses to hosting, production, printing, communications and advertising providers solely to carry out these permitted uses for Milieu. This does not authorize a provider or unrelated brand to exploit your content for its own independent campaign.
Content covered, duration and compensation. The standing grant covers the content in your currently approved public kit and later revisions you choose to submit and Milieu approves for publication, until you withdraw permission, subject to Sections 6 through 8. A private draft, upload or pending revision is not available for promotion under this grant. Once content is removed from your approved public kit, Milieu will not initiate new uses of that removed content under the portal grant. Prior lawful distributions are addressed in Section 7. Unless separately agreed in writing or required by law, no additional fee or royalty is payable for uses within this license. Adult talent signup asks for this grant expressly; you may later withdraw it without closing your account or hiding your kit.
Earlier permissions. A permission recorded under an earlier version remains limited to its original scope. In particular, a grant for one identified approved kit does not become a standing grant for future revisions merely because these terms change. Fresh affirmative acceptance is needed to obtain the expanded scope. Publication may continue under a valid earlier release without that expanded promotional permission.
5. Limits on the license
The marketing license excludes private drafts, sign-in or contact records, gated social URLs, private messages, financial details, and profile fields you have not selected for public display. It does not authorize an unrelated product endorsement, sale of your content as a standalone asset or dataset, AI model training, biometric identification, a digital replica, voice cloning, or a materially fabricated performance. Such uses require any separately applicable agreement and consent.
No permission extends beyond rights you can lawfully grant. Milieu will not knowingly use the license to make a false endorsement, misrepresent your qualifications, or disregard a documented rights restriction. Student-athlete, union, school, league, existing contractual and other applicable legal requirements remain effective. A separate agreement controls a specifically negotiated use only to the extent it is valid and lawful; it cannot waive mandatory protections.
6. Withdrawal, revocation and removal requests
Consent withdrawal is separate from routine unpublishing and needs no agency approval. You may withdraw agency promotion permission through Withdraw Milieu promotion permission in your portal without hiding your kit. Withdraw consent & hide media kit immediately disables this site's public kit and hosted portfolio delivery, revokes site-managed link access, and also withdraws the portal marketing permission. Your private draft remains until you request deletion and the agency completes its review, subject to the limited retention below.
For off-site removal, deletion, account closure or a rights complaint, email hello@milieuagency.com or call +1 (574) 314-7590. Include your kit URL or username, the affected material, what you want removed, and a reason if you can provide one. A reason is not required to withdraw consent. This contact route remains available after account closure, without creating a new account.
After withdrawal, saving, submitting or approving a later kit does not silently restore promotional permission. To restore permission, contact Milieu to review and affirmatively accept a fresh explicit grant. Withdrawal operates prospectively from receipt. Milieu will stop initiating new uses under the withdrawn permission and, without undue delay, discontinue active promotional placements it controls and instruct providers acting on its behalf to stop the affected use. Off-site posts and campaigns require review and removal through those services; the portal control is not an automatic deletion command for every external platform. We will take any additional deletion, notification or other action required by applicable law.
For a particular image or campaign, identify the material or URL if available so we can locate it. A request described as revocation, withdrawal, cancellation or rescission will be assessed according to its substance and applicable law. These terms do not determine whether a separate contract may legally be rescinded or limit any remedy for invalid consent or unauthorized use.
Routine portal unpublishing requests follow the 7-calendar-day review period in Section 3. For email removal, account or privacy requests, we aim to acknowledge receipt within 7 calendar days and provide a substantive response within 30 days, or sooner where required by law. If an applicable law permits more time, we explain the reason and revised deadline within the original response period. These response targets do not delay immediate portal consent withdrawal or legally required action.
7. Previously permitted uses and limits on recall
Once material has been uploaded and lawfully made public or distributed with your permission, later withdrawal, deletion of an upload, account closure or a request for rescission does not guarantee that it can be erased or recalled from every prior permitted use. Subject to mandatory law and any valid rescission remedy, withdrawal does not retrospectively make a use unlawful if it was lawful and within the permission in effect when it occurred.
Examples include brochures already delivered, emails already sent, presentations already received, downloaded media kits, screenshots, reposts, search-engine caches, platform archives and copies retained by independent recipients. Milieu cannot guarantee that every third party will return or delete such copies, or that every search result or archived version will disappear. This practical limitation does not give Milieu permission to launch, renew, reprint, redistribute or indefinitely maintain advertising after the underlying permission ends.
Any continuing use under a separate project license must remain within that agreement and applicable law, including any enforceable withdrawal, termination, deletion or rescission right. After a deletion review, Milieu retains only the minimum consent, request, approval, audit and transaction evidence reasonably needed for a specific remaining obligation or dispute. Access is restricted, retention lasts only as long as that purpose requires, and we explain any exception that affects your request. Backups may remain through applicable recovery periods and remain subject to the same use restrictions. Retention is not permission for public display or renewed marketing. Milieu remains responsible for legally required steps concerning its providers and other recipients; this section is not a blanket disclaimer of that responsibility.
8. Mandatory rights and lawful processing
A content license and a lawful basis for processing personal information are distinct requirements. Nothing here waives applicable access, correction, deletion, objection, consent-withdrawal, publicity, copyright, consumer or other nonwaivable rights, or excuses an unlawful use. Milieu will assess required removal and any lawful retention exception on the facts of the request. A public upload is not a waiver of all privacy rights.
Where applicable law requires erasure or notice to recipients, Milieu will comply even if material was previously distributed or a license was previously granted. Continued processing after withdrawal requires a valid independent legal basis where the law permits it; Milieu will explain any basis it relies on in responding to the request. See the privacy request procedure for identity verification, applicable deadlines and appeals.
9. Relevant legal provisions
These references explain the distinction between permission, ownership and removal. They do not themselves grant Milieu a license, determine that every listed law applies to every member, or replace the conditions and exceptions in the law.
- Youth work and participation
- US Department of Labor Fact Sheet 43 describes federal age, duty and hour restrictions for covered nonagricultural employment. Indiana Department of Labor guidance explains the state’s current requirements. Milieu’s age-13 private-kit policy and age-14 participation threshold do not replace these rules, applicable exceptions or other jurisdictions’ laws.
- United States copyright
- 17 U.S.C. § 106 addresses the copyright owner's rights to authorize reproduction, adaptation, distribution, public performance and display, subject to statutory limitations. The permissions above are a limited license; public availability does not itself transfer copyright.
- Indiana publicity rights
- Indiana Code § 32-36-1-8(a) requires
previous written consent
for covered commercial uses of a personality's publicity rights, subject to the chapter's scope and exceptions. Section 8(b) also addresses invalid consent arising from certain void or voided student-athlete agency contracts. Other applicable states' publicity laws remain relevant. - Consent and erasure where GDPR applies
- Regulation (EU) 2016/679, Article 7(3) states:
The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
This concerns past processing, not unlimited future use. Article 17 provides qualified erasure rights; Article 17(2) requires reasonable steps to notify other controllers about erasure requests for public data when its conditions are met. Article 21 protects applicable objection rights, including direct marketing.
10. Records, changes and contact
Age-participation update, October 20, 2026. The age-13 private-kit option and 14–15 guardian-approved offer path are described in Section 1 and the privacy notice. This update does not broaden existing adult promotional grants or grant promotional rights for a minor.
Milieu records the accepting account, time, terms version, exact promotional statement, scope and signup, submission or promotion-control source, together with subsequent withdrawal records. Publication releases separately identify the selected content submitted for review. An effective standing grant is reused for later approved public kit revisions; it is not recorded again merely because a kit changes. Changes to these terms will be dated and material changes brought to your attention; broader permissions require fresh affirmative agreement. Earlier permissions remain limited to their original scope, and this revision does not retroactively record your acceptance.
Reported external agreements. The agency may record an owner's report of a verbal publication or promotional agreement, including whether the owner reports guardian authorization. These records are labeled pending confirmation and distinguish the reporting date from the agreement date. They do not create a signature, retroactively record online acceptance, validate an agreement or replace any required written consent. A report alone does not activate publication or promotion, expand an earlier release or waive mandatory rights. Private drafts remain excluded; existing publication review, age restrictions, offer-specific guardian approvals and withdrawal controls still apply. Contact us to correct or question a report.
The routine unpublishing procedure and retention explanation are also reflected in the dated Privacy & participation notice. They do not expand an earlier publication release or marketing permission.
If a provision cannot lawfully be enforced, it applies only to the extent permitted, and the remaining terms continue to the extent lawful. No severability provision cures missing consent or eliminates a statutory remedy.
For permission questions, a copy of your record, a rights complaint or a removal request, contact hello@milieuagency.com or +1 (574) 314-7590. Identify your kit and the affected material if possible. Do not send passwords, bank details or identity documents in your initial message.
